WorldofGood.com, an eBay Marketplace Terms and Conditions for The Marketplace
Access Program.
If eBay Inc. (“eBay”) accepts your application to sell within the WorldofGood.com, an eBay Marketplace, (“WorldofGood.com”) as a Marketplace Access Program Agent (“MAP Agent”), and by clicking on the “I have read and accept the WorldofGood.com Terms and Conditions for the Marketplace Access Program,” you (“You” or “Your”) will be subject to the following terms and conditions, including those available by hyperlink, (the “Terms and Conditions”): (1) In order to participate in the WorldofGood.com Marketplace Access Program (the “Program”) You must satisfy and maintain at all times the following criteria: a) You must have an eBay feedback score of at least 25; b) You must maintain a positive feedback rating of 98%; c) You may only sell goods on WorldofGood.com that are produced by groups that (i) are listed in the then-current Producer Directory (currently accessible at /ns/Producer%20Directory) and (ii) have authorized You to serve as their MAP Agent in the manner described in the then-current MAP Agent manual (currently accessible at /ns/TSP%20Manual%20PDF) (the “Manual”); and d)You must remain in good standing with the Producer(s) You serve. (2) eBay is not responsible for any part of a MAP Agent’s relationship with Producers and has no liability for any additional terms and conditions that are set between MAP Agents and Producer groups, and You are not working in an agency capacity or in any way on behalf of eBay. You will defend, indemnify and hold us (and our officers, directors, agents, subsidiaries, joint ventures and employees) harmless from and against any and all claims, losses, liabilities, costs and expenses, including reasonable attorneys’ fees arising out of or related to Your relationship with and/or business dealings with Producers. eBay may participate in the defense at its own expense. (3) Your activities in the WorldofGood.com Marketplace are governed by these Terms and Conditions, the then-current user agreement and privacy policy that governs use of www.eBay.com (the “eBay User Agreement”), the then-current user agreement and privacy policy that governs use of www.PayPal.com (the “PayPal User Agreement”) and the Manual. These Terms and Conditions shall be governed by and are hereby incorporated into the eBay User Agreement by this reference. Your obligations herein are in addition to Your obligations in the eBay User Agreement, PayPal User Agreement and Manual. (4) You acknowledge that nothing herein requires eBay to approve Your application to be a MAP Agent. (5) Without limiting any rights eBay has under the eBay User Agreement, the PayPal User Agreement, or the Manual, and in addition to such rights, eBay may limit, suspend, or terminate our service and user accounts, prohibit access to our website, delay or remove hosted content, and take technical and legal steps to keep You off WorldofGood.com if we think that You are creating problems, possible legal liabilities, or acting inconsistently with the letter or spirit of eBay’s policies. eBay also reserves the right to cancel unconfirmed accounts or accounts that have been inactive for a long time. (6) These Terms and Conditions may not be modified by You without the prior written approval of eBay which may be withheld in eBay’s sole discretion. eBay may amend or modify these Terms and Conditions at any time upon prior notice to You, with the form of such notice to be determined by eBay.
